Malaysians have displayed that peaceful assembly is possible — Proham

August 31, 2012
AUG 31 — Proham congratulates the people of Malaysia who displayed their patriotism at Dataran Merdeka on the eve of independence of Malaya. They came from all walks of life in large numbers and showed that it is possible that Malaysians can occupy the public space in peace, harmony and goodwill.
Democratic freedom provides avenues for ordinary people to organise themselves in peaceful ways not only to celebrate but also express their views and grievances to the general public. This is in the spirit of the Federal Constitution which guarantees “the right to freedom of speech and expression” as well as “the right to assemble peacefully and without arms” as enshrined in Article 10.
Proham also recognises that while the police had initially indicated in writing to the coalition of 47 NGOs barring them from entering the historic Dataran Merdeka, the police did not prevent people to gather in the surrounding areas nor did they disperse the crowd. This discretion and restraint by the police is commendable. It is an example of how citizens’ action for peaceful assembly can be well managed. This is in contrast to some previous public assemblies where excessive force was used in crowd dispersion.
Proham believes that KL City Hall should be more people friendly in facilitating the historical Dataran Merdeka as a truly people’s space for democratic expression. City Hall, which manages this space, must respect the people’s human and constitutional right for free access and use of the public space.
Therefore, in keeping with democratic freedoms, city officials must be more “people friendly and pro-human rights” especially as KL aspires to rank higher in the Global Cities Index (GCI) where KL is currently occupying a low ranking (in 49 position out of 66 cities of the world)
In this context of the 55th year of Malayan independence, Proham calls on the federal government:
● To reintroduce local government elections so that the mayor of KL and the City Hall board is managed by people elected by the people of KL and accountable to them.
● To declare Dataran Merdeka as the democratic space for freedom of expression as this will be reflective of the aspirations of the people of the city.
Proham congratulates all Malaysians as we celebrate 55 years of Malayan independence and 50 years of the founding of Malaysia, that we must strive harder as a nation to live in peace, prosperity and harmony for the betterment of all the people of our county.
* Released on behalf of Proham by Tan Sri Simon Sipaun (Proham chairman), Prof Handan Adnan (Proham deputy chairman), Tan Sri Ramon Navaratnam (Proham member) and Datuk Dr Denison Jayasooria (Proham secretary-general).

Sue KL mayor instead, says Suaram

What SUARAM suggested was inline with my comment in the previous post, of which I said the authorities wasted the people's money.

The NGO blames Ahmad Fuad’s negligence for losses incurred during the Bersih rally.
PETALING JAYA: Kuala Lumpur City Hall (DBKL) should sue Kuala Lumpur Mayor Ahmad Fuad Ismail instead of Bersih leader S Ambiga for alleged losses incurred during the April 28 rally for clean and fair elections.
This advice came today from Suaram.
“DBKL should sue Ahmad for his negligence,” said K Arumugam, chairman of the human rights organisation. “It was his wrong decision of not allowing the rally in Dataran Merdeka that led to the losses.”
Arumugam’s statement was in reaction to DBKL’s threat to sue Ambiga and Bersih steering committee member Maria Chin Abdullah.
Yesterday DBKL sent the two activists a letter of demand, seeking compensation amounting to RM351,203.45.
DBKL director general Salleh Yusup said City Hall would initiate legal action against both unless they paid up within two weeks.
City Hall’s threat came about a month after the government filed a suit against Ambiga and Bersih, seeking RM122,000 in restitution for damages allegedly incurred during the same rally.
Arumugam said DBKL had no grounds to sue since the alleged damage was on public property.
Human rights lawyer Edmund Bon meanwhile said DBKL’s action was further evidence of a conspiracy to demonise the Bersih movement.
“It is a systematic scheme by the government, government agencies and government owned media to demonise and silence calls by Bersih for free and fair elections,” said Bon.
He added that the authorities should “go after individuals who marred a peaceful protest instead of Ambiga”.
Warga Aman, a predominantly Indian NGO, has also urged DBKL to drop its plan to sue Ambiga and Maria.
“The action is insensible and irrelevant. Why demand only from Ambiga and Maria?” Warga Aman secretary general S Barathidasan said when asked for his comment.
Warga Aman caught the nation’s attention last month when it proposed setting up thosai stalls in front of Deputy IGP Khalid Abu Bakar house to mock his statement that similar protests in front of Ambiga’s house were within the law.

DBKL demands Bersih pay RM351,000 in damages over rally

Right from the beginning, DBKL mayor has been breathing through the same passage of the nostril with BN leaders. Who could have such authority to bar Bersih 3.0 Rally holding at Dataran Merdeka? Defitely not the mayor!

The move of BN leaders was political. The people only requested to sit peacefully at Dataran Merdeka. So the mess was created by the authorities. They have unnecessarily wasted the people’s money.

KUALA LUMPUR, June 19 — The Kuala Lumpur City Hall (DBKL) is claiming RM351, 203.45 in damages from Bersih for the April 28 rally here, just weeks after Putrajaya sent a claim for RM122,000 from the coalition calling for clean and fair elections.

The Malaysian Insider understands a letter of demand was sent to Bersih co-chairman Datuk Ambiga Sreenevasan as well as steering committee member Maria Chin Abdullah this morning.
The letter, signed by DBKL director Datuk Haji Salleh Yusup, gave the two Bersih leaders 14 days to make the payment, failing which legal action would be initiated.
“Yes, I received the letter of demand this morning. We have referred it to our lawyers and they will be responding to it,” Ambiga told The Malaysian Insider.
A copy of the letter made available to The Malaysian Insider quoted Salleh as saying that the Bersih 3.0 rally on April 28 has caused “chaos” in Kuala Lumpur and damage to public property.
According to the letter, the department of landscape and recreation incurred RM74,552 in losses and RM19,654 to erect steel barriers around Dataran Merdeka.
DBKL’s department of mechanical and electrical engineering sustained RM26, 856.95 in losses while the department of urban transport logged RM5,900 in damages to “signboards and billboards” around the city.
DBKL has also demanded Bersih pay for the overtime costs of its officers who were on duty that day, saying that the accumulated costs for transport, food and drinks amounted to RM224,240.
“Even though you were not allowed by the KL Mayor [and] police to organise the Bersih 3.0 rally in Dataran Merdeka, and even though there was a court order dated April 26... (both of you) still went ahead with the rally on April 28, which went out of control and caused chaos and destruction of public property,” said the letter.
Tens of thousands had thronged the federal capital city’s streets on April 28 for the election watchdog’s third rally for free and fair elections.
The opposition-backed protest had kicked off peacefully but turned chaotic shortly after 3pm when several protesters breached the three-tiered barricades surrounding the historic Dataran Merdeka, which had been blocked off to them via a court order obtained by the police.
A parliamentary reply later said the police fired a total of 967 tear gas canisters and grenades at the crowd, which the Information Ministry estimated to be 22,270 according to pictures taken by state news agency Bernama.
